Terms of Service

By accessing or using the Octopus platform operated by Lab63 ("Company", "we", "us", or "our") at octopusify.org, you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access the service.

Octopus is an AI-powered multi-tenant SaaS platform that provides enterprise risk intelligence, compliance management, fraud detection, cybersecurity analytics, portfolio risk management, and related services through ten integrated modules.

The platform includes features such as AI-driven analysis via Google Gemini, real-time alert delivery, automated reporting, data source integrations, and collaborative workflows for enterprise risk teams.

You must create an account to access certain features of the platform. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized account access
• Ensuring all users within your tenant organization comply with these terms

We reserve the right to terminate accounts that violate these terms.

Each subscribing organization ("Tenant") receives an isolated database environment. We implement strict multi-tenant isolation to ensure your data is not accessible to other tenants. You retain ownership of all data you input into the platform.

By using our platform, you grant us a limited, non-exclusive license to process your data solely for the purpose of providing the services described herein.

You agree not to use the platform to:

• Violate any applicable laws or regulations
• Transmit malicious code, viruses, or disruptive data
• Attempt to gain unauthorized access to other tenants' data or systems
• Use the AI capabilities to generate misleading compliance reports or fraudulent risk assessments
• Reverse-engineer, decompile, or attempt to extract the source code of the platform
• Resell or sublicense access to the platform without prior written consent

Access to specific modules requires an active subscription. Module subscriptions are billed according to the plan selected during onboarding. Payment is processed through Stripe. All fees are non-refundable unless otherwise stated in your Enterprise Agreement.

We reserve the right to modify pricing with 30 days' advance notice. Continued use after the effective date of a price change constitutes acceptance of the new pricing.

The AI analysis features within Octopus (powered by Google Gemini) provide risk assessments, scores, and recommendations. These outputs are intended to assist — not replace — qualified professional judgment.

We make no warranty that AI-generated outputs are accurate, complete, or suitable for any specific regulatory or legal purpose. You are solely responsible for decisions made based on platform outputs.

The Octopus platform, including its software, AI models, UI/UX design, module architecture, and documentation, is the exclusive property of Lab63. Nothing in these terms transfers ownership of our intellectual property to you.

Your data, reports, and configurations remain your intellectual property.

We target 99.9% monthly uptime for the core platform services. Scheduled maintenance windows will be communicated at least 24 hours in advance. Credits for downtime below the SLA threshold are available upon request per your subscription agreement.

To the maximum extent permitted by law, Lab63 shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the platform, including but not limited to lost profits, data loss, or regulatory penalties.

Our total liability in any calendar year shall not exceed the fees paid by you in the preceding 12 months.

You agree to indemnify and hold harmless Lab63 and its officers, directors, employees, and agents from any claims, liabilities, damages, or expenses arising from your use of the platform in violation of these terms or applicable law.

Either party may terminate this agreement with 30 days' written notice. We may terminate immediately for material breach. Upon termination, you may export your data within 30 days before it is securely deleted from our systems.

These terms are governed by the laws of the State of Florida, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Miami-Dade County, Florida.
